These Terms of Service explain how SeenAs works, what you can expect from the services, and what is expected from you as a client.
Please read them before buying a service, booking a paid session, or using any materials provided by SeenAs.

1. Who we are

These Terms apply to services provided by SeenAs (“SeenAs,” “we,” “us,” or “our”).

2. Who these services are for

SeenAs provides marketing strategy, diagnostic research, messaging, positioning, and AI-supported marketing services for small businesses, founders, creators, service providers, and small teams.

By buying or booking a service, you confirm that you are using the service for business or professional purposes, unless you tell us otherwise before purchase.

If consumer protection laws apply to you, nothing in these Terms removes rights that cannot legally be excluded.

3. Services covered by these Terms

These Terms apply to all SeenAs services, including but not limited to:

  • Marketing Signal Reports

  • Custom Marketing AI Assistants

  • Signal Strategy Coaching

  • strategy sessions, audits, reviews, and consulting work

  • website, offer, content, positioning, and messaging feedback

  • any related documents, templates, prompts, recordings, or recommendations

Each service may also have its own description, scope, price, timeline, and deliverables listed on the relevant sales page, proposal, invoice, or written agreement.

If there is a conflict between these Terms and a signed agreement or proposal, the signed agreement or proposal will apply to that specific service.

4. The nature of the work

SeenAs provides strategic guidance, research-backed recommendations, marketing diagnostics, messaging support, and AI-supported tools.

We do not guarantee specific business results, revenue, traffic, enquiries, sales, rankings, followers, conversion rates, or client acquisition outcomes.

Marketing performance depends on many factors outside our control, including your offer, pricing, audience, market, execution, sales process, product quality, timing, website implementation, traffic sources, and ongoing business decisions.

We will bring thoughtful analysis, strategic judgment, and practical recommendations. You remain responsible for deciding whether and how to implement them.

5. AI-assisted work

SeenAs may use AI tools to support research, pattern-finding, analysis, structuring, drafting, or workflow creation.

AI is used as a research and productivity tool. Human judgment is used to interpret findings, prioritize what matters, and shape recommendations.

You understand that AI tools may produce incomplete, inaccurate, or generic outputs if used without review. SeenAs reviews and edits AI-assisted work before delivering it to you, but you are responsible for checking final materials before using them publicly or commercially.

You must not submit sensitive personal data, confidential third-party information, trade secrets, regulated data, or any material you do not have the right to share unless we have agreed in writing how that information will be handled.

6. Booking, ordering, and acceptance

A service is considered booked or ordered once one of the following happens:

  • you complete checkout on the website;

  • you pay an invoice;

  • you accept a written proposal;

  • you confirm the work by email or other written message; or

  • we both otherwise agree in writing to begin the work.

We may refuse or cancel a project if it is outside our scope, if there is a conflict of interest, if the project involves unlawful or harmful activity, or if we are not the right fit for the work.

7. Your responsibilities

To complete the work properly, we may need information, access, feedback, files, links, context, or decisions from you.

You agree to:

  • provide accurate and complete information;

  • respond within reasonable timeframes;

  • give access to the materials needed for the service;

  • make sure you have the right to share any materials you send;

  • review deliverables carefully;

  • make final decisions about implementation;

  • use the work lawfully and responsibly.

Delays in providing materials, feedback, or decisions may delay the project timeline.

8. Timelines and delivery

Estimated timelines are listed on the relevant sales page, proposal, or invoice.

For example, a Marketing Signal Report may be delivered within 3–5 business days after we receive the required materials, unless a different timeline is agreed.

Timelines begin when payment has been received and all required materials have been provided.

We will make reasonable efforts to meet agreed timelines, but delivery dates may change if:

  • you delay in sending materials or feedback;

  • the scope changes;

  • additional research is required;

  • technical issues occur;

  • illness, emergencies, or events outside our reasonable control occur.

9. Payments, invoices, and taxes

Prices are shown on the website, proposal, checkout page, or invoice.

Payment terms will be stated at checkout, on the invoice, or in the proposal. Unless otherwise agreed, payment is due before work begins.

You are responsible for paying all applicable taxes, duties, bank fees, currency conversion fees, or payment processing fees unless the law says otherwise.

If payment is late, we may pause work, delay delivery, withhold final deliverables, or cancel the service until payment is received.

10. Cancellations and rescheduling

For scheduled calls or coaching sessions, please give at least 24 hours’ notice if you need to reschedule.

If you miss a scheduled session without notice, the session may be considered used and may not be refunded or rescheduled.

If we need to reschedule, we will offer a reasonable alternative time.

For larger projects, either party may cancel the work in writing. You will remain responsible for payment for work already completed, time already spent, and any non-refundable costs incurred before cancellation.

11. Refunds

Refunds depend on the service purchased and the stage of the work.

Marketing Signal Report

Because the Marketing Signal Report involves custom research and analysis, refunds are generally not available once work has started.

If you cancel before work begins, we may issue a refund minus any payment processing fees or administrative costs.

Custom Marketing AI Assistant

Because the Custom Marketing AI Assistant is built around your business, audience, offer, voice, and strategy, refunds are generally not available once setup or customization work has started.

Signal Strategy Coaching

For coaching or consulting packages, unused sessions may be refundable only if agreed in writing. Completed sessions, strategy work, research, preparation, and delivered materials are not refundable.

Legal consumer rights

If consumer protection laws apply to your purchase, you may have additional cancellation or withdrawal rights. Nothing in this refund policy limits rights that cannot legally be excluded.

12. Revisions and feedback

The number of revisions, feedback rounds, or review calls included in a service will be listed on the relevant sales page, proposal, or written agreement.

If no revision terms are listed, the service includes one reasonable round of clarification or correction related to the agreed scope.

Revisions do not include:

  • a change in project direction after delivery;

  • new services or deliverables;

  • changes caused by incomplete or inaccurate information you provided;

  • implementation work unless specifically included;

  • unlimited edits, rewrites, or ongoing support.

Additional work may be quoted separately.

13. Intellectual property

You keep ownership of materials you provide to SeenAs, including your brand assets, website copy, business information, documents, images, and other pre-existing materials.

SeenAs keeps ownership of our pre-existing methods, frameworks, templates, prompts, processes, know-how, internal research systems, and materials developed independently of your project.

Once full payment has been received, you may use the final deliverables created specifically for you for your own business purposes.

Unless otherwise agreed in writing, you may not:

  • resell, license, distribute, or package SeenAs materials as your own product;

  • share internal templates, prompts, frameworks, or working documents publicly;

  • copy SeenAs methods or deliverables to create a competing service;

  • remove attribution from materials where attribution is required.

For Custom Marketing AI Assistants, your usage rights apply to the assistant setup, workflows, and documentation delivered to you, subject to any third-party platform terms.

14. Third-party tools and platforms

SeenAs may recommend or use third-party tools such as AI platforms, document tools, analytics tools, website platforms, payment providers, scheduling tools, or collaboration platforms.

We do not control third-party tools and are not responsible for their availability, security, pricing, features, terms, outages, or changes.

You are responsible for reviewing and accepting any third-party terms that apply to tools you choose to use.

15. Confidentiality

Both parties agree to treat confidential business information shared during the project with reasonable care.

Confidential information may include business strategy, customer information, analytics, private documents, login details, unpublished offers, internal plans, and other non-public information.

Confidentiality does not apply to information that:

  • is already public;

  • becomes public through no fault of the receiving party;

  • was already known before disclosure;

  • is independently developed;

  • must be disclosed by law.

16. Portfolio use, testimonials, and examples

We may ask to use your project as a case study, testimonial, example, screenshot, or portfolio piece.

We will not publicly share confidential information, private data, sensitive business information, or unpublished materials without your permission.

If we use anonymized examples, we will take reasonable steps to remove identifying details.

You can say no to portfolio use by telling us in writing.

17. No professional legal, financial, or accounting advice

SeenAs provides marketing strategy, messaging, positioning, research, and decision support.

We do not provide legal, financial, tax, accounting, investment, medical, or regulated professional advice.

You should consult a qualified professional before making decisions in those areas.

18. Acceptable use

You agree not to use SeenAs services, deliverables, AI assistants, prompts, or materials for unlawful, misleading, harmful, abusive, discriminatory, infringing, or deceptive purposes.

You also agree not to use the work to spam people, misrepresent your business, violate platform rules, infringe intellectual property rights, or make claims you cannot support.

19. Limitation of liability

To the fullest extent allowed by law, SeenAs will not be liable for indirect, incidental, consequential, special, punitive, or business-loss damages, including loss of revenue, loss of profits, loss of data, loss of goodwill, lost opportunities, or business interruption.

To the fullest extent allowed by law, our total liability for any claim related to a service will be limited to the amount you paid for that specific service.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

20. Indemnity

You agree to indemnify and hold SeenAs harmless from claims, losses, damages, liabilities, costs, and expenses arising from:

  • materials or information you provide;

  • your use or implementation of the deliverables;

  • your breach of these Terms;

  • your violation of law or third-party rights;

  • unsupported claims you make in your own marketing.

21. Termination

We may suspend or terminate work if:

  • payment is late;

  • you do not provide required materials or feedback;

  • you ask us to do something unlawful, unethical, or outside scope;

  • communication becomes abusive, threatening, or inappropriate;

  • continuing the project is no longer workable.

If the project is terminated, you remain responsible for payment for work completed, time spent, and costs incurred up to the termination date.

22. Privacy

Your use of the website and services may involve the collection and processing of personal data.

The Privacy Policy explains what personal data we collect, why we collect it, how we use it, and what rights may apply to you.

23. Changes to these Terms

We may update these Terms from time to time.

The latest version will be posted on the website with the updated date.

For services already purchased, the Terms in place at the time of purchase will usually apply unless the change is required by law or you agree otherwise.

24. Governing law and disputes

These Terms are governed by the laws of Switzerland, unless mandatory consumer protection laws say otherwise.

The courts of Zurich will have jurisdiction over disputes, unless mandatory law gives you the right to bring a claim elsewhere.

Before starting formal legal proceedings, both parties agree to try to resolve the issue in good faith by email.
